The OWI conviction will stay on your record permanently. It is not like points that fall off your record after two years. It is a criminal offense. Also, you are not eligible for an expungement. This advice assumes that you were convicted in Michigan.

My close friend has left the state in which he was charged a felony DUI, what can happen to him?

Your friend will need a good attorney, have to prove he has changed his life 180 degrees and reformed. It is possible to argue that should mitigate the issues and punishment against him at this time. I need details to render a more specific opinion but can tell you this will NEVER go away on its own and part of his reform will have to be facing up to the issues he caused himself in the past.

f BAC is .17 or higher and this is a first offense: - Up to $700 fine - Up to 180 days in jail - Up to 360 hours of community service - Up to one year license suspension - 6 points on a driver's license - Mandatory completion of an alcohol treatment program - Ignition interlock use and compliance after 45 days license suspension is required to receive a restricted driver's license. Convicted drunk drivers have limited driving privileges, are prohibited from operating a vehicle without an approved and properly installed ignition interlock device, and are responsible for all installation and upkeep costs for the device. Get a lawyer from the area. Your lawyer may be able to get your charge reduced to an OWI, not the super drunk. I do it all the time; however, it depends on the Judge, prosecutor, County. Some will, some won't. If you are pro-active and get into counseling, AA, go to the MADD VICTIM IMPACT PANEL, quit drinking altogether, (you are on bond and can't drink anyway) The more you do before you go to court, the better your results will be; however, you really need legal representation.
