Can I get charged for possession if I was illegally searched and was caught having small amount of drugs?

Michael Lawrence Chastaine
Answered by attorney Michael Lawrence Chastaine (Unclaimed Profile)
Criminal Law lawyer at Chastaine Jones
Where the search was illegal depend on the circumstances. As a general rule, most searches are not illegal. You should get legal counsel to advise you on this. Bit of the search was truly illegal then the drugs are not admissible as evidence in court and the case should be thrown out.

It wont be dropped down from trial. Whatever that means, but it may well be continued to another date.

Is it illegal to be arrested without being Mirandized, statement made later without legal counsel present, then used against you?

Answered by attorney Philip Daniel Hache
Criminal Law lawyer at Law Offices of Phil Hache
You have some conflicting statements in there. You stated they were arrested then on the way to the station made an incriminating statement and that statement was used as basis for arrest and nothing else. Sounds like they were already arrested by the time that statement was made. If the statement was made after arrested, and the person was never read their miranda rights, then it may be possible to suppress the incriminating statement. That doesn't mean that the charges will automatically get dropped, but it is helpful to suppress incriminating statements.
