Do I have to admit to the officer that I have had any alcohol and can I refuse a portable breathalyzer test?

Generally you do not have to say anything, but, at least in Michigan, if you have a drivers license you have impliedly consented to testing.

First, the police are required to obtain a search warrant in order to search your blood, unless you gave them consent. If they conducted a blood test, they are looking for any substance that could impair your ability to operate a motor vehicle. Usually, they are looking for amphetamines, marijuana (THC) or a metabolite thereof, barbituates, opiates, and the like. You should consult an experienced DUI attorney for this case. You may have a number of defenses available to you. A recent change in Mississippi DUI law makes a DUI conviction a permanent part of your record for enhancement of subsequent offenses. Do not attempt to defend this on your own.

Can you be charged with a DUI if you are not driving?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
You can be charged. In Utah, you have to have "actual physical control" of the car to be convicted of DUI. You have an argument that you weren't in control of the car, though, so you may want to hire an attorney to help you fight the charge.
