You can be charged with DUI based on your facts BUT that does not mean that you do not have a defense to the charges. You should consult with a local DUI attorney in your area, depending on what the government is alleging you could have a defense of drinking after driving. It is the governments job to prove that the alcohol in your system was ingested before you drove and impaired your ability to drive. This is a jury trial defense meaning that you need an attorney to represent and defend you at trial.

The solution is to speak with the court clerk about getting a date to get the judge to allow you time to finish the program. Find out if there is a "bench warrant" (arrest warrant). Call the public defender for quick advice how to avoid the possibility of arrest pending the court hearing.

This happens all the time. Call the judge's office and tell whoever answers that you want to come in and have the bench warrant lifted. They will have you come in that day or the next. When you show up, apologise even though you feel like it was not your fault (it was) and promise the judge you will show up from now on when you are supposed to and maybe he/she will re-appoint your lawyer or appoint you a new one.
