First, there was a bench warrant issued for your failure to appear in court. So, you will need to turn yourself in on the warrant. Before you go to jail, you should retain an attorney that can work out a quick bail, so you will in and out. OR you can continue to do nothing and wait for them to arrest you on the warrant during a routine traffic stop.

You can be charged with the crime.  You should fight it.  Hire an attorney to help you.  In many states, it is a defense to say that you were using a prescription medication.
