You currently do not meet the residency requirements to file for divorce in California. You must reside in California for at least 6 months and 3 months in the county you intend to file for divorce. At present, Texas would have jurisdiction for a divorce. You can either wait until you are in California six months and file for divorce or you can file for legal separation. Legal separation does not have a residency requirement. Once you have been in California for 6 months, you can then amend your legal separation to a divorce. However, this may not stop the other party from filing for divorce in Texas first.

If the other side did not respond to interrogatories, your attorney should have filed a motion to compel and asked for attorney fees. By now, the time to file the motion has probably passed. Subpoenas do not take very long to prepare, maybe an hour or two maximum. Find a more aggressive attorney or an attorney with more time for your case.

You are entitled to 1/2 of the retirement benefits earned during the marriage and to spousal support. You may need a restraining order that's the only way to get him out of the house. Hopefully you have some evidence of the abuse, other than just your word, filing police reports, witnesses, etc. You probably need to hire an attorney to help you.
