Can wife delay divorce until she gets her greencard from me?

See an attorney. Alimony is based on the marital standard of living and in a short term marriage typically is for half the length of the marriage, so 2 1/2 years. She can delay the divorce just by filing motions for support and fees. There is no guarantee that a divorce can be done in 6 months - unlikely if there are any court hearings at all.

After my husband signs the paper, can I just take the paper to the court myself and proceed with the filing without depending on the attorney?

If the Petition for dissolution of the marriage was filed or answered by your attorney, y he must file the papers or you must substitute him out of the case before you can file on your own behalf or hire another attorney to finish it.

Possibly looking into separation but do not want to have to move out due to having 3 children. How do you get spouse to legally leave?

William H Nebeker
Answered by attorney William H Nebeker (Unclaimed Profile)
Divorce lawyer at Havens Law, LLC
In your initial filing, you request possession of the marital estate. If you also request custody this is usually granted to the parent that is awarded custody. After the initial filing for separation or contemporaneously, you would file a motion for temporary support. In that motion you would ask for the court to order your spouse out of the house and award it to you until the court disposes of the matter.
