Can the wife sue for adultery while divorce process is still ongoing?

Bruce Provda
Answered by attorney Bruce Provda (Unclaimed Profile)
Divorce lawyer at Provda Law Firm
It is highly unlikely that he would be arrested for adultery so stop worrying about that. If you were seeing him before the divorce was filed there might be the grounds of adultery if after separation, not so much. New York is a no fault state so there is no real reason for there to be additional grounds. You should consult an attorney.

Is there any way to continue the divorce without her?

I'd be a fool, and soon enough at risk of being jailed, if I gave you an answer. Paperwork like this needs to be professionally reviewed.

Can spouse during a divorce while I am still living there list the house for sale?

Stephen Marc Drucker
Answered by attorney Stephen Marc Drucker (Unclaimed Profile)
Divorce lawyer at Legal Action Workshop Professional Corporation
When a petition is filed and served, there is not supposed to be any financial exchange except in the normal course of business.  The sale of property may be allowed if it is specifically authorized by the court. You may want to speak with the mortgage company to see what documentation they have.  You may also want to go to court to see all the documents that the court has on your case.  You may not have any knowledge of some documents that may have been filed with regard to the sale of property. Make sure to bring the case number to court (and supporting documents) so that the clerk can locate your file. If you find that there has been some wrong-doing, you will have to speak with an attorney right away to determine your best option.
