You are entitled to half of the marital estate which accumulated during the period of your marriage, including any pay down of the equity or increase in the market value of the residence even if it is in your husband's name only. As to what your rights are, each marriage is a unique and individual and therefore the best I can save areas that you are entitled to a fair and equitable settlement or judgment under all the circumstances.

You could be entitled to an offset for community money used to pay for or improve his separate property. The determination of that offset is extremely fact intensive, and you have not provided all of the necessary information.

He may have an interest, at least in your interest depending of the actual circumstances. Divorce court's are generally not overly concerned regarding the individual titling of assets or whether debts are individual or joint.
