      You pose a question that I would typically answer in the affirmative. I suspect what you really want to know is if your pension amount is going down (monthly payments?) does this reduce the amount your former spouse is to receive.  When a QDRO divides a  pension that the participant is going to receive into the future, how much of that the former spouse will receive and whether that will change depends on how the QDRO is worded.      Read over the language that deals with what your former spouse is to receive.  If it is worded as a percentage of the total payment, then it should adjust accordingly in the event your pension goes down....or up.      I hope you had this covered when you divorce. If your parents are buying the vehicle, and you have it titled in your name only , it would not be a marital asset it would be your separate property.  Only if you put marital funds (money) toward the purchase or trade in a marital vehicle, would this new vehicle be marital subject to equitable distribution. The theory is that a gift comes from an outside source and did not involve use of marital funds to purchase it.  As long as you dont put your spouses name on it (called comingling) the it remains your separate property.

You can file in the state you are a resident of at the time you seek a divorce. In California, the requirement is that you be a resident of the State of California for six months before filing for divorce, and a resident of the County in which you file for at least 3 months. Even if you don't meet the residency requirement, a work around is possible that will allow you to file now.
