How can I get a divorce if I just moved from one state to another if my wife and child are still in my old state?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)

You cannot file in FL until you have been a FL resident for more than six (6) months, but even if you could file in FL, the FL courts may have no jurisdiction to grant you any relief other than to dissolve the bonds of marriage, because apparently Ohio is the home state of the child, and where you last lived together as husband and wife. You may be able to file in Ohio, but you should speak with an OH attorney to determine if your physical presence is required, and to review the pros and cons of filing in Ohio, so you can consult with a FL attorney and do the same, to determine if you have a choice, and if so, which State would be in your best interest.

How will being pregnant by another man affect my divorce from my husband?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)

Technically, the unborn child is still a child of the marriage and your Husband is the legal father of the child, even though he is not the biological father. Therefore, specific paperwork would need to be done during the divorce, such as the biological father signing an Affidavit of Paternity. You should consult with an attorney.

Can i file for divorce in florida if i got married in new york?

Answered by attorney Nicole Kessler Ferry
Divorce lawyer at Nicole Kessler Ferry, P.A.
If you have lived here for 6 months, you can file for divorce. Since you don't know where he is, you will have to publish the divorce for 4 weeks in  a newspaper that is in the last known address for him. It is called service by publication.  After the publication has ended, the newspaper will give you verification that you would then file with the Court. The Court can enter a default and set a final hearing. This process is in my opinion much harder for an unrepresented party to complete. I highly suggest hiring an attorney to handle for you. Best of Luck.
