What does your decree say about the house and who gets to live in it and when it has to be sold? That's what governs. If she vacated the house and damaged it, you may have some recourse in the court based on her fiduciary duty to you as a coowner.

If you properly serve him with divorce papers, there is nothing for him to "fill out" unless he wants to ask the court for something different than you have requested. If he does nothing, you may be able to proceed by "default," which means the divorce goes forward without his participation. In Arizona, which is where I practice, the income of step-parent or a "significant other" is not included in a child support calculation. Again, in Arizona, the fact that you have another child that you support,(assuming that child was born after the original child support award) could actually reduce the amount of support you pay.
