Maybe. It depends on whether it was used as the marital home, was community property used to pay the mortgage and maintenance and how long did the people live there as husband and wife. If only 6 months, probably not. 20 years, probably yes.

If you are getting a divorce and asking these questions it would appear that you do not have divorce counsel. That is unwise. Given the fact that the house and are apparently in your name I would suggest that the house be sold in order to clear the debt to the extent possible. Your exposition of the facts implies that no one will and him money who does it for a living, why would you wish to do so as an amateur?

In Utah, you do not need a federal marshal to serve your spouse with a complaint for divorce. Typically, sheriffs deputies were constables are called upon to fill that role. There are also private process servers that you can find in phone book or online. The cost of serving process usually depends upon the amount of effort involved in getting someone served, as well as the amount of travel involved, but is normally in the range of $30-$50.
