Mostly likely you will get the home, but she will be entitled to reimbursement of one-half of the the community property funds that you have used on the property during the years you were married (payments toward your loan principal, repairs, taxes, insurance, etc).

Is it automatic that a wife is awarded 50 percent of pension up until the time of divorce or should it be stipulated in divorce papers?

An award of a pension would be 50% of the community's interest. The award should be reflected in the Judgment and later in a Qualified Domestic Relations Order so the retirement plan can properly divide the plan or the benefits.

If counsel never filed dismissal as stated in the record, can my husband continue with the divorce?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
The divorce that was never dismissed can be continued but amendments to the documents will be needed to reflect the reconciliation and any assets or debts that might have been accumulated during that reconciliation. See a local family law attorney immediately to protect yourself. Good luck.
