How can I have my wife arrested and kicked out of the house?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
Clearly you have tried and failed to have her arrested, which is a matter of the police officers discretion. Your next move would be to go to the court and to ask for an order to remove her from the home most probably as part of a complaint for either divorce or separate maintenance.

What are some offensive actions a husband can initiate to protect him and his daughter?

Answered by attorney Terry Anne Buchanan (Unclaimed Profile)
Divorce lawyer at Law Office of Terry A. Buchanan
Your inquiry is quite extensive for a response in this forum. Fathers/husbands have equal rights to custody under California law. A meeting with an attorney would be strongly recommended at this time in order to take offensive action for yourself/himself and the child.

Can I file any paperwork with the court before the 30 days?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
You really cannot do anything until the other side responds or the 30 days has elapsed because whatever you file the the court has to be served on the other side and you don't know where that person is. Once the 30 days goes by and no response is filed you can request a default and move forward from there without serving any further documents on the other side.
