If by some chance it is contested because of the time separated will I still be granted a divorce and does she have to show up to the hearing?

Answered by attorney David Ari Goldberg

You would file in South Carolina as you would not have jurisdiction in California. However, your wife could file in California since she is a resident of the state and most likely meets the jurisdictional requirements. In California, you would be first able to obtain a divorce after the 6 month waiting period. Since you would be filing outside of California I can not say if there would be a delay to being granted a divorce.
