Am I entitled to my husband's 401K in a divorce if he started investing in it before we got married?

Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
You will probably be entitled to one-half of the amount that was earned during the marriage, not any part that was earned before the marriage date. Because both parts have continued to grow during the marriage, it takes an expert in this area to determine exactly how much is from his pre-marital days and how much was earned during the marriage.

If his income is twice as high as mine will the courts remove my children from me because of income situation?

Your income situation is not generally a reason to remove children from your home. Once child support starts getting paid, that should improve your income situation.

You can request a default which entails filing a form with the court if a resident of California. Thereafter you would file a default judgment which an attorney consultation can assist you with.
