California is a no-fault state. What that means is that the court no longer considers who did what or why the marriage ended. Assets purchased from community income (during marriage) will be divided fairly and equitable, and spousal support (if requested) will in most cases be awarded to the lower earning spouse. Infidelity is common and judges do not consider it in division of assets. The only way infidelity could impact you is in regard to child custody; but in that case, only if your infidelity is indiscreet and affecting the children.

How can I get divorced on grounds of abandonment as I do not know of her whereabouts as of July 2004?

Colorado doesn't have any "fault" grounds for divorce, so abandonment is irrelevant. All that is required under Colorado no-fault divorce is for one of the parties to say that the marriage is "irretrievably broken". If you have been a legal resident of Colorado for more than 90 days you can file for divorce in Colorado and accomplish service by publication in Colorado. Service by publication only permits the court to grant the divorce and deal with any property located in Colorado. Since you say there are no children and no property, that won't make a difference to you.

You do not have to move out, especially if there are children. It also depends if you can afford to keep the home yourself and if you want to keep it. If you have an agreement for him to pay your expenses to live elsewhere you may want to consider moving. You also need to consider factors such as what are the costs of maintaining the house versus the rental value of the house. Does the house have equity and should the house be sold? You should discuss these factors with an experienced family law attorney before moving out.
