In a nutshell, while your military disability pension is normally not susceptible to being divided as community property, to the extent an election is made to receive benefits in lieu of what would have been divisible community property pension benefits, said payments are divisible.

Legally, if you have filed a valid proof of service then you have met your burden and it is up to the other party to appear.

You should receive one-half of the community interest in the pension.  This is defined as one-half of the contributions made during marriage and any/all interest or other accumulations on those contributions. Pay particular attention to clauses relating to survivor's benefits, to which you may be entitled but which may have been omitted from the order.  You should also ensure that the Plan receives a certified copy of the order once it is filed, don't just assume that your ex-husband's attorney will handle it.  Finally, consider paying an attorney or actuary to review the QDRO with you and let you know if there are any issues you need to be concerned about.  Best of luck to you.
