Although it is possible that the judge will order your attorney to keep representing you (it happened to me once), that is not the law and you should expect that the judge will let your attorney out. You always have the option of representing yourself. If your spouse can afford to pay for all or a portion of your attorney's fees, you should go into court and ask the judge to order your spouse to give you some money for an attorney. If your spouse cannot afford to pay any of your attorney's fees and you qualify financially, you may be able to get an attorney for free. You should check with your local courthouse to see if they have a pro bono program. Not all of the counties in Florida have such a program.

This should have been taken care of in the original divorce judgment.. including a time frame for refinancing the home.. If not you can file a motion for her contempt of the court's order in the original court where you got divorced complaining that her actions in no paying the mortgage are adversely affecting you. Your desired result is to force her to pay up, on time, and if she does not pay to either refinance the home in her name alone or sell it to pay off the mortgage.

In Utah, abandoning your spouse (e.g., willfully deserting your spouse for a period of more than a year) could stand in the way of alimony, but leaving the marital home in conjunction with a filing for divorce will not bar you from seeking alimony.
