How do I remove an ex from a house title?

Michael C Hyde
Answered by attorney Michael C Hyde (Unclaimed Profile)
Divorce lawyer at Office of Michael Hyde PLLC
Your boyfriend can re-mortgage the home into his name alone. To have the deed changed he will have to get his ex to sign a Quit Claim deed over to him. If he truly does not know where his ex is living, he can ask the court to quiet title in his name and put a legal advertisement in the paper to that effect, giving her an opportunity to respond. If she doesn't respond within a specified amount of time, then the court will remove her name from the title or cause the register of deed to issue a new title in his name only.

How do I find out if I am divorced?

Answered by attorney Robert E McCall (Unclaimed Profile)
Divorce lawyer at Law Office of Robert E. McCall
NEVER rely on nameless clerk/voice on the telephone. Go to the courthouse and make a personal inquiry. It is possible suit was filed but was dismissed due to no follow up. Also if you were separated check clerk office for the county where your spouse was living.

If I agreed to pay alimony in my divorce, can it be stopped so that I can retire?

Answered by attorney Marcia J. Mavrides
Divorce lawyer at Mavrides Law
There is a new alimony statute in Massachusetts that became in effect as of March 1, 2012. When you can terminate alimony must be reviewed in conjunction with your divorce agreement/judgment. You really need to consult with an attorney to review the terms of your divorce to advise you whether you can retire now or have to wait until full social security retirement age, which is what the new statute suggests. It is an important issue and you should not wait too long, as I am sure you want to plan your future.
