I live in FL and need to divorce my husband in NY-very amicable divorce with a child involved-do i have to find a lawyer that practices in both states

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
You do not state whether you have an order to pay child support or it is just paid voluntarily.  Also, understanding that you have been separated for 10 years you do not state whether there are any assets or liabilities to divide.  If there were not, then, but for the child, you could do the divorce in Florida...but all you could do is the divorce.  The proper jurisdiction to resolve the issues with the child (even if they are resolved between thetwo of you) is New York since that is where the child resides with the other parent.   Best of luck, Cindy Vova

What can I do about false imprisonment for a TRO that was never filed?

Robert Joseph Merlin
Answered by attorney Robert Joseph Merlin (Unclaimed Profile)
Divorce lawyer at Robert J. Merlin, P.A.
You may be able to sue her for abuse of process, malicious prosecution and/or tortious interference with relationship with a child. But I warn you, such a suit would cost you a lot of money as well. Perhaps you can ask the judge in your divorce case to award attorney's feed to you against your former wife for the unnecessary fees she caused you to incur.

How many years of separation from a marriage justifies dating?

Divorce lawyer at Musilli Brennan Associates, PLLC
I suspect that after four years of separation there will be little relevance in the continued separation or divorce that he is dating.
