Can I complete my five year pending divorce or start a new case?

You can continue with the case so long as it has not been dismissed. Without seeing the paperwork I cannot advise you on whether you can fix it. You have free assistance and counseling from the Family Law Facilitator at your Courthouse. I'd use it.

How long do I have to wait before I can have a court date?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
He does need to be served with the Petition (or he can sign an Acceptance of Service in front of a notary). Your final documents cannot be submitted to the court until 64 days after he is served; however, you might not need a court date at all. I recommend you consult with an attorney for additional information.

When filing divorce papers, do you need to list all debts or only those that will be contested?

When filing a petition for divorce, one option is to attached a property declaration that includes all the community property. Another declaration can also be filed that lists the property that you claim is your separate property.
