What can I do if my spouse doesn’t want to cooperate with the divorce?

Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
You can obtain the divorce without his cooperation. If he isn't willing to cooperate things will be more difficult, but he can't keep you from getting the divorce.

My Ex-husband won't pick up child and court has awarded him 4 other children?

Answered by attorney Randy Lee Warren (Unclaimed Profile)
Divorce lawyer at Warren Law Group PC
You state the problem but not the desired resolution. Do you want him to make all those appointments or do you want to take away his right to the 3 year old? For the latter, keep a written log of the calendar for pickups and returns. When you can demonstrate a consistent and ongoing pattern, move to modify the visitation order to adopt the "status quo", then present your written log as evidence of what the status quo schedule truly is.

Is there waiver of some sort that will hold in court that I can have my husband sign giving up his rights to the house should a divorce occur?

Tajara Dommershausen
Answered by attorney Tajara Dommershausen (Unclaimed Profile)
Divorce lawyer at Petit & Dommershausen, S.C.
You need a Marital Property Agreement done laying out what is yours (inherited) and what will be yours in the future if a divorce would occur. This is like a prenuptial agreement done while you are married. If he won't sign it, you need to think twice about using the inherited property for anything that could be later termed marital.
