My husband receives a VA pension, Social Security, and workers compensation. Would I be entitled to spousal support?

Howard Edward Knispel
Answered by attorney Howard Edward Knispel (Unclaimed Profile)
Divorce lawyer at Howard E. Knispel, P.C.
Spousal support is dependant on the comparison of income of the parties. Without doing a formula inputing both incomes it is impossible to tell. You weree only married one year so if there is any spousal support it wouldbe very short term, but it is likely you would get none.   Yoiu are entitled to child support from the father of the child.

Can marital conduct effect a solid prenuptial agreement?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
It depends on what marital conduct you are talking about and how solid the pre-nuptial is. I imagine you are claiming infidelity or spousal abuse. Those would normally be the only two things that would seem to cause a problem. Perhaps drug use, but then only if it affects the marriage. Regardless, the pre-nuptial would normally say that each person's property remains that person's and neither party may collect alimony. So is there a good reason to challenge the pre-nuptial? If not, just get divorced and move on with your life.

What can I do to contest the divorce and attempt to get her to reconcile and save the marriage?

default-avatar
Answered by attorney Terry Anne Buchanan (Unclaimed Profile)
Divorce lawyer at Law Office of Terry A. Buchanan
California is a no fault state so no actions included in your question would qualify as a reason to prevent your wife from receiving half of the community estate. If one spouse wants a divorce you can only mark a box on the Response that you believe the marriage is not over. Otherwise if your wife wants a divorce there is nothing in the law that will prevent her from moving forward.
