How do me and husband divorce if out of state?

Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
In Michigan its easy is a no-fault divorce state and as long as you agree to a property settlement.. a judge will mostly agree or grant you a default divorce judgment In California where you live I do not know.. contact a local CA attorney (you will file for a divorce in CA and get his agreement on a judgment or get a default judgment of divorce) However since I believe that CA is a community property state..things work a little differently so I advise you to hire a local attorney in CA.

If my ex-husband's mother passed away and left both of us equal amount of inheritance, would this allow him to stop alimony payments?

default-avatar
Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
The answer would generally depend upon what impact, if any, the inheritance had upon your income, your assets, and your need for alimony to continue at all, or at any rate other than what it is already set at. Generally, if your current income, and any additional income resulting from the inheritance, is sufficient to meet your needs, then alimony may be reduced or terminated. You should consult with an attorney about the specifics of your situation, and your options.
