I have no idea exactly what you are talking about..Generally the person filing a divorce, files the papers in court and pays the fee upon filing, then he/she serves it... the defendant is not required to pay a fee to answer. if it was never filed.. it really does not expire.. except the circumstances/facts may change if nothing has changed.. change the dates and pay the required fees to file it and serve it.

It is very doubtful you will be awarded spousal support. He will not be obligated to pay any child support for children which are not his. You can file and receive a divorce regardless of the fact that he is in the military (though there may be special rules). Sounds like you need to learn to drive and get a steady job.

The same way you do when he isn't in prison. You file for divorce and have him served. It will be easier to have him served in prison because they know where he is.
