An Indictment is a formal charge issued by a grand jury. If the grand jury has returned an Indictment against you, the prosecutor will seek an arrest warrant for you. You will be arrested on the warrant and brought before a judge. When you are brought before the judge, you will be advised of the charges. At that time, you can advise the court you do not have funds to retain counsel, and counsel will be appointed to represent you at no expense to you. The issue of bail will also be addressed by the court. Whether you can be released on your own recognizance, without posting funds, will depend on the nature of the charge, your prior record, and the rules in the jurisdiction where you are charged. There are significant differences between state and federal courts when it comes to release on bail, and without knowing in which forum you have been indicted, it's difficult to provide a more specific answer. If you are certain you have been indicted, you may want to consider surrendering yourself rather than waiting to be arrested.
