If it's a misdemeanor theft (less than $500), then the potential sentence is up to 1 year in jail and up to $1,000 fine. He needs to hire an attorney to represent him to keep this off his permanent record.

In general, it is a conflict of interest for any attorney to represent two potential accomplice charged with the same crime. It is never recommended that a wavier be signed to have one attorney represent two defendants for the same crime. A person accused of a crime is never forced to testify about anything that may incriminate him or herself.
