Is there a chance that my son could get reinstated on a probation violation?

All of that is at the discretion of the judge. He could be sentenced to the max, or restored to probation and the terms changed or extended. It all depends on the facts of the case and the persuasiveness of his attorney.

Would they make a deal on a domestic violence and rape case?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)
Criminal Law lawyer at Gregory Casale, Attorney at Law
It sounds like you are the victim and not the defendant. If that is the case, you can certainly make your wishes known to the prosecutor. They should take your position into account. Don't forget, if you are the complaining witness and the state has no other evidence except your word that this happened, you have a lot if influence over the outcome of the case. You should speak to an attorney about your concerns. You need to be careful that you do not violate the law in trying to accomplish your goals as well.

Am I required to report to probation even though a warrant for vop

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
Yes, you still are required to report to probation even though a VOP warrant has been issued.  However, when you report, you will be taken into custody on the VOP warrant. Since you, apparently, are aware that a warrant for your arrest has been issued, you may want to just turn yourself in at the jail.  You can, and most likely will, be held without bail on the VOP warrant.  So you may not get released until the VOP is resolved.  (In such a situation, there is no reason to bond out on the new charge unless you, also, can bond out on the VOP or resolve the VOP and get released on it,)   If you bond out on the new charge while being held on the VOP, you will not get jail credit on the new charge after you bond out on it, even though you still are in jail on the VOP. If you turn yourself in on the VOP warrant, it may be useful to your attorney in any motion to try to get a bond set on the VOP.  Your attorney can argue that you, obviously, are not a flight risk since you turned yourself in rather than evade capture.  That doesn't mean the judge will agree.  But from time to time that argument has worked with my VOP clients (but it somewhat depends on the nature of the new charge).
