Appeal pertaining to sentencing

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
More information is needed.  Since I do not know what your question is, here is some general information.  In Florida an appeal must be filed within 30 days following the sentencing and judgment (from the date the sentencing order is filed by the judge).  If you're appealing a misdemeanor/county court case, the appeal is filed with the Circuit Court.  If your appealing a felony/circuit court case, the appeal is filed with the District Court of Appeal that covers that Circuit. The trial attorney is responsible for filing a "Notice of Appeal" if the defendant directs him/her to file for an appeal.  That is just the "notice of appeal" -- not the appeal, itself.  If the defendant wants to appeal and cannot afford an attorney, the defendant is entitled to have an attorney appointed to represent him on appeal.  Even so, it is the responsibility of the trial attorney to file the "notice of appeal" and other legal pleadings to get an attorney appointed.  If the defendant wants a norice of appeal filed, he/she must inform the trial attorney in time to get the notice of appeal filed before the 30-day period runs out.  Unless the defendant is determined to be indigent for purposes of appeal, a filing fee must be filed with the "Notice of Appeal."     The procedure is much more detailed -- but this is some basic information.

I’m 16 and got charged with a class B misdemeanor for $200 worth of items what will be my consequence?

Matthew Murillo
Answered by attorney Matthew Murillo (Unclaimed Profile)
Criminal Law lawyer at Law Offices of Matthew Murillo
California doesnt separate misdemeanors into classes. California only has 3 levels of severity for crimes - infractions, misdemeanors and felonies. There is no such thing as a "Class B" misdemeanor. If this was in another state, you should contact an attorney in that state since criminal law differs from state to state.

Are restraining orders admissible in stalking cases?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
Probably not, but I would have to do research. Something that tends to prove a bad character in a criminal case is generally not allowed, unless the state jumps through certain hoops.
