You need to ask your attorney.  He/she should be able to give you a definite response and explanation. However, here is some basic information: Prosecutors are not under any legal obligation to make any plea offers. Prosecutors in some Florida jurisdictions have a general policy that if they made a plea offer, but the Defendant's attorney proceeds to take depositions, they will withdraw the offer.  That is legal since they are not under any obligation to make an offer at all.       In some jurisdictions, prosecutors are especially adamant, in certain types of cases, about withdrawing a plea offer if a victim is deposed -- for example:  child sex cases.   Again, talk to your attorney about this -- and the general practice or policy in your jurisdiction.

A presentence report, often called a probation report, is used to assist a Judge in determining the appropriate sentence to impose on a defendant convicted of a crime. Typically, following a guilty plea or a verdict by a jury, the defendant is interviewed by an officer with the Probation Department. The probation officer questions the defendant about his or her background, prior criminal record, family, educational and employment history, financial status and perhaps, his or her involvement in the crime. The probation officer also may interview family members and obtain documents from third parties or the prosecution. The officer then writes up his or her findings in a report which goes to the Judge before sentencing. Reference letters on behalf of the defendant may be attached. Usually, the officer also includes a sentencing recommendation, which the judge may follow or not. Probation officers are paid by the government, but they do not work for the prosecution or the defense. They are independent, working for the Court. Presentence reports are one of the most important parts of a criminal case. Judges rely heavily on them. It is important to be truthful with the officer, and if there is a concern about talking about the facts of the case, the defendant should ask his lawyer whether the statement about the offense can be submitted in writing. The defendant must be allowed an opportunity to review the report and discuss it with his attorney before sentencing. He or she may present objections to the report and offer corrections. The final sentencing decision, however, is always up to the Judge.

What will my punishment be for getting caught with weed, Xanax and a scale?

The punishment is just one aspect of the criminal case against you. It appears that you will be lucky just to be charged with possession of the weed and the Xanax, both are felonies, and the punishment might be up to 5 years for each, but could be more depending upon how you are charged. You might be charged with possession with intent to distribute on each. You say that they have probable cause, and that might statement might be a big mistake, it takes an attorney to review all of the facts and circumstances and even do research into the issues within your case. Get one now, before it is too late.
