Depending on the amount allegedly stolen and the jurisdiction where the event occurred, shoplifting can be met with a mere citation (infraction), or charged as a misdemeanor or even a felony, with possible jail sentences of 6 months to 3 years. It will be up to the D.A. to determine how the crime will be charged. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.

If you get charged, you will need to hire a private criminal defense attorney. You ask if you should be worried. Well, yes. But it appears that you have a reasonable hypothesis of innocense, and that the state cannot produce any evidence contrary to that, so a judgment of acquittal must be granted. Get counsel on this immediately if you are arrested.

This is an urgent legal matter!  FIRST -- I believe someone under these circumstances should  immediately consult with a criminal defense attorney before doing or saying anything to anyone!   Unless a person is willing to risk spending many years in prison -- and then face the possibility of being locked up again, this time via a civil commitment, after his release from prison, he/she should consult with a good, experienced criminal defense attorney who has handled numerous cases involving child sexual offense crimes.  There are many special rules and laws that apply to such cases. If a person cannot afford to consult with, or retain, an attorney (although many criminal defense lawyers will do a free 1/2 hour initial consultation), then I still believe it is important not to talk to anyone or do anything until he/she can.  The person has that right -- regardless of whether he/she is, or is not, guilty!   There is far too much -- and it is far too complicated -- to explain here why it is absolutely essential to talk to a good, experienced criminal defense lawyer before talking to anyone else or doing anything (even if the person is only being "maybe" accused).     Persons who are accused (or, maybe, being accused), should not be intimidated by, or fooled by, the fear/threat that law enforcement can file charges in the future if the person doesn't cooperate with requests by law enforcement.  Law enforcement and/or the state can (and often has) file/d charges in the future -- even if the accused person cooperates.  Also, be aware that, despite being told that a lie detector test can clear a person's name, it rarely does.  Law enforcement knows that lie detector tests are not reliable.  That's why (unless there is an agreement by the suspect) they are not admissible in court in Florida.  Consequently, the mere passing of a lie detector test does not guarantee charges will not be brought -- even if that seems to be the indication.  There are numerous cases in which persons pass lie detector tests and still get charged.  There are numerous times when an innocent person fails a lie detector test -- as well as times when a guilty person passes one.    Again, there is too much -- and it is far too complicated -- to explain all of the legal considerations, options, and ramifications here.  I advise anyone accused (or, maybe, being accused) of a sexual offense to talk to a good, experienced, criminal defense lawyer before agreeing to talk or do anything else.
