Will the court be able to recollect person 1 and legally charge them with anything?

The court does not charge people, the prosecutor does that. The prosecutor is probably going to deal with person # 2 right now, and once that case is over possibly turn their attention to person # 1. So, I advise you to retain an attorney for # 1.
