If I violated first offenders program before court date, what do I do?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
You should speak to an attorney with experience handling these types of cases in your county. If your use of marijuana is prescribed by a physician you may have a defense to the charges you face in court. Regarding the DUI program kicking you out, you need to contact them about the steps necessary to be readmitted, unless you are attending the DUI classes due to a court order in which case you will need to return to court for a new court order before they will accept you back into the program.

Can I be given a notice for obligations and license suspension 5 years after my DUI charge?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
You are asking if you can be given notice, when you are being given notice. Clearly, you can be. Do you know what clearance of obligations means? It means there is nothing more expected of you. Your obligations have been cleared. Are you upset at that notice? Then you are too stupid to be behind the wheel. Your license is suspended for 10 years. Now you know. Spend that time reflecting on how your life went wrong.

Is it an in-house policy which the DUI Program enforces, or is it at the State or Court level?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
You have several issues, as to the first DUI, by getting a second subsequent DUI, you have violated the terms and conditions of the first sentence, and obviously violated the terms of your treatment. That requires you to, in many instances start the treatment program over ,If the treatment center agrees and If the judge allows it. This is all separate from the second DUI, for which you will be charged, and if convicted could face a maximum of one year in jail.
