What charges am I facing for filing a false police report? If you confess to doing so, then you could potentially face criminal charges with up to a year in jail, if the DA chooses to file. Pregnant women are regularly jailed, as it is not an excuse or defense to any charges. You are going to be interviewed and subpoenaed by the DA to testify against the defendant. You will either have to continue the lie or confess it to get him ?off?. You should hire an attorney to try to negotiate a resolution of this that keeps you out of jail. If serious about hiring counsel, feel free to contact me.

One favorite technique of law enforcement is to have the alleged victim (or somebody on their behalf) call you while the police record the conversation. You need a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard. In this type of case, look for an attorney with experience in sex crimes. You do NOT want some DUI lawyer handling this. Get a lawyer NOW.

It depends on the nature of the dismissal. If the dismissal was "with prejudice," that means the state cannot recharge you. If the dismissal was "without prejudice," that means the state can recharge you as long as it is still within the statute of limitations (generally three years for felonies, though specific felonies may have longer statutes of limitation). Whether the case was dismissed with or without prejudice depends on the reason for the dismissal.
