What is the usual punishment for 16 year old or minors that have shoplifted? Is there any way to get a court date dismissed?

default-avatar
Answered by attorney Dan Eugene Chambers (Unclaimed Profile)
Criminal Law lawyer at Chambers Law Firm, P.C.
A lot depends on whether the minor has a prior history of arrests or "sustained petitions" (which would be called prior convictions in adult court). Assuming the minor has no prior record, there is a reasonable chance the minor will be released home to a parent or guardian and placed on probation. You should speak with an experience criminal defense attorney right away.

What does it mean if I received a letter stating detention certificate?

default-avatar
Answered by attorney Edward Jerome Blum (Unclaimed Profile)
Criminal Law lawyer at Law Office of Edward J. Blum
It means the State didn't file charges and so the arrest is now counted as a detention which is less serious than an arrest. If asked, "Have you ever been arrested?" the arrest you describe doesn't count as an arrest in determining your answer.

If the victim in a case does not show up during the preliminary hearing or trial, can the case still be tried?

In California, hearsay testimony is admissible at the preliminary hearing for a witness and might be at trial also, depending on the circumstances.
