Will I be locked up for life if you have two strikes on drug charges?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
If he has two strikes, and the DA charges him with a new felony (e.g., possession of an illegal weapon), then yes, he could be sent to prison for 25 years to life. Whether or not that will actually happen is another question. This is a very serious situation. He needs an attorney with experience in handling three strikes cases immediately.

What happens to the person who put up the bond when the person does not go to court?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
The bond is posted to ensure that the defendant appears in court. If the defendant fails to appear and the court declares the bond forfeoited, then the person who posted the bond/bail money looses it.

What legal standing and case law do I have to back up my motion?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
You have not mentioned what the charges were. It would help to know the charges. If, in fact there was no jurisdiction to begin with the whole thing can be thrown out, and should be. You should make a motion for a new trial. However, much reasearch would need to be done, and you seem to be able to do that. So, get to the law library in the courthouse and do some research on the issues you want answers to. Good Luck.
