If that is the case the police officer is stretching the meaning of the statute; you should win. Fight the case. You might be responsible for resisting arrest if you caused the police officer to chase you. That did not happen in your case. There is no resisting arrest in Massachusetts.

I am not sure if there is more than one case or more against your ex-boyfriend. They could just charge a probation violation to avoid a trial and make the standard of proof lower. They could also file a new case and violate his probation and proceed on the new case. A lot depends on how serious the probation violation case was and how serious the new case would be, for example if there were injuries requiring hospitalization or broken bones.
