Is being arrested and incarcerated without being given an initial hearing, grounds for a lawsuit?

Answered by attorney Larry K. Dunn (Unclaimed Profile)
Criminal Law lawyer at Weo Office Suites, LLC
A person is entitled to be brought before a judge within 72 hours of their initial arrest unless good cause is shown to a judge. The remedy for failing to have a detention hearing or arraignment is to be released from custody. However if you were unlawfully detained for twenty three days it may be the basis for a lawsuit. You should consult with an attorney who practices in civil law.
