Can I be charged if I am not home and the police search my house?

Answered by attorney George Martin Derieg (Unclaimed Profile)
Criminal Law lawyer at The Derieg Law Firm
It will be tough to prove that you were in possession of a controlled substance when you were not home. You might be, I've seen weirder things in California criminal courts. The most important questions is; where were the illegal substances found? In your room? In your drawer in your room? In your wallet, with your ID in it? Did you admit that the illegal substances were yours? I see alot of spouses, girlfriends, boyfriends admitting drugs were theirs in order for their significant other on probation is not violated on probation. I don't think you will be charged for two reasons 1. the police were looking for your boyfriend and 2. it is much easier to prove a probation violation then prove a crime against someone who was not even home at the time of the search.

Can I take court action against her to recover court costs and fines?

Answered by attorney Harley Ives Gutin
Criminal Law lawyer at Gutin Wolverton
You can try. I don't see how in a civil suit you can blame her friend unless you had some kind of written contract that was enforceable. But it would be a unique idea and maybe the "friend" would just settle rather then risk losing in small claims court.

How much time in jail for domestic violence?

Answered by attorney Gabriel Eric Dorman (Unclaimed Profile)
Criminal Law lawyer at Law Office of Gabriel Dorman
In general, whether or not jail is a possibility depends on a large number of factors including, but not limited to, whether you are charged with felony or misdemeanor domestic violence, the nature and extent of injuries, if any, prior criminal history, etc. If you do not already have one, I would suggest you hire an experienced criminal defense attorney to represent you as this is best way to ensure that you get the best possible result for your case.
