What can I do? Defend the criminal charges. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate. Your attorney may be able to keep you out of jail by getting you an offender program. If you can't afford private counsel, apply for the Public Defender at your first court hearing. Listen to his advice.

This is a factual dispute. The only way to fight is go all the way to trial. If it was in a room to which everyone had access, like a living room or kitchen it will be difficult to win. Your boyfriend has a better chance if it was in a room that belonged to someone else where the were letters identifying it as someone elses. Maybe if there were items right next to the gun that had your name or another resident's name he would have a stronger argument. Difficult not to accept a plea bargain if he is facing 25 to life.
