Do I have a good chance if I appeal my guilty plea?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)

On what grounds would you think you can appeal your conviction which was based upon your voluntary plea. A successful appeal would require you prove the court made a substantial error of fact or law in its ruling on your case. But the court did nothing except take your plea, AND you formally waived all your rights, including appeal rights, when you entered that plea. Saying you were pressured is entirely contradictory to your on the record testimony, and your signed Tahl form, both of which said you entered your plea voluntarily. You don't get a do over just because you aren't happy with the deal you agreed to, nor do you get to talk about whatever facts and defenses you think you may have had, but waived by entering your plea. They are now irrelevant. The case is over.

If they are saying he did two robberies, no witnesses, no evidence, no nothing, and no time has been offered, what will happen?

If he is being charged, there must be some evidence against him. If he has an attorney, this question should be addressed to his attorney. If he does not have an attorney, he needs one now.

Leonard D. Harden

It depends on your history as to your record. However a B felony carries a 3.5 to 7 years maximum and possession of any controlled drug is a B felony.
