Sex charges are very serious and you are well advised to hire an attorney. Barring something unusual, and the "rape kit" was completed timely, the government should be able to get DNA profiles. But that is just the beginning of the story. The DNA that is obtained has to be "matched" to a profile of someone, and in this case, if you are a suspect, you. Do not volunteer to give a DNA sample. Without your consent, a warrant is required. Again, this is very complicated and you need a qualified criminal defense attorney to assist you. Without knowing the age of the minor (or your age) it is impossible to tell you the exact charges that could be filed, or what the potential sentence could be; there are several charges that can apply to any given situation. Yes, consent does matter, again, depending on the age of the other person, but in certain circumstances, (for example, if the minor is under the age of 14 in California), consent does not matter and is not a defense. One other thing to watch out for in any sex case is lifetime registration as a sex offender. This can be more onerous that any direct sentence and is one aspect of any case that has to be considered.
