Yes, because switching price tags is also a form of retail fraud or shoplifting. If you either take the item without paying for it or you switch the price tags and passed the last available check out spot at the store when it was open to the public, you are guilty of retail fraud or shoplifting. Simply because you had a guilty conscience and did the right thing shortly thereafter does not negate that. However, it would be unlikely they would find out about it in time to confirm who you were in order to file charges against you unless you paid for it with a credit card or something.

It is hard to say exactly what a judge will do, but most likely your brother-in-law will have his probation revoked and will be sentenced to the remainder of his original jail time. But the final decision will be up to the judge.

Have your attorney request an adjournment. If you do not have counsel and intend to miss the hearing, make sure that you bring proof of your treatment with you when you turn yourself in. Also, do not wait for the police to pick you up for missing the court date. Turn yourself in as soon as you get out of treatment.
