Can i get my felony expunged

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
You are not eligible for an expungement. If the case resulted in a deferred sentence you will be able to get a non-disclosure order that keeps the conviction and arrest from being seen by most of the public. It appears that this will be possible in 2015.

What is the penalty for breaking probation by living in a different county than the one you were registered in?

default-avatar
Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Criminal Law lawyer at Austin Hirschhorn, P.C.
For a violation of probation, the court might extend the probation, treat it as closed unsatisfactorily, or sentence the violator to the remaining time on the original sentence. If he was sentenced in Alaska and lived in North Carolina the past five years and is now in Michigan I would recommend that he contact the probation department in Alaska and see what they suggest. If he has stayed out of trouble all of this time, they might consider treating the probation as being over with. I don't believe they would extradite him to Alaska for this or expect him to return there. I assume that he has not heard from the probation department in Alaska and they haven't figured out where he is and tried to contact him since he has been away from there. Good luck, you've got some work to do to clear up this mess.
