Is driving without license a probable cause for the police to search vehicle without consent?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
Yes, even a minor traffic infraction can be the basis for the stop and can lead to a search. There are a mountain of cases to know in search and seizure law. You have given practically no facts. Us attorneys work with facts and the law. Without the facts we cannot theorize about law which should be applied. You can't make meatloaf without meat, we cannot make legal conclusions without facts.

Is it legal for an off duty officer to threaten me while at my mental health appointment?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
They are bullies, they can do whatever they want because what is the remedy. At least they didn't beat you up and try and get you arrested. Best to just be chill against those guys.

Does an arraignment for a felony dui have to be within 30 days

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
No, you do not have to be arraigned within 30 days on a felony DUI in Florida.  However, the time period for speedy trial (175 days unless speedy trial is waived) starts running on the day of arrest or, if no arrest (unlikely on a DUI), the date the Information (formal charging document) is filed by the State Attorney's Office.
