What can I do if I was charged for a burglary while I was under heavy medication?

Answered by attorney Jonathan S. Willett
Criminal Law lawyer at Jonathan S. Willett Attorney at Law
Technically, you do have a defense. Burglary requires a "specific intent" to commit a crime. Your ingestion of the drugs may negate that necessary mental state element. This is a complicated but valid defense.

What should be done if I got pulled over in a vehicle that did not belong to me and police found drugs in the car?

If you are not guilty and the State still wants to continue your prosecution, then your only choice is a trial. Your attorney, in the right situation, can file a motion to suppress based on a lack of affirmative links. Please do not take this as a knock on your attorney. I do not know the fine details.

Can I own a registered gun although my husband is a convicted felon of drug possession?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
you can own and possess the gun your husband is not allowed to touch or be in possession of the gun. keep it with your things, including all ammo etc. At no time should any part of it have his fingerprints on it because he has a felony conviction, he will never be allowed to possess or touch any gun.
