Yes. You need a license, insurance and registered vehicle in order to drive on the public roads. He had no license and the vehicle was unregistered, and probably safe to assume that he had no insurance. The license, insurance and registration is not a suggestion, but a requirement. So, he should expect to go to jail.

You cannot expunge it. You may be able to seal it depending on the offense. The waiting time is 5 years on felonies and either no wait or a 2 year wait on misdemeanors. The wait period starts when you finish the deferred. You should have a lawyer represent you in a nondisclosure petition.
