Will my DUI stay on my record from seven years ago?

default-avatar
Answered by attorney Craig W Elhart (Unclaimed Profile)
Criminal Law lawyer at Craig W. Elhart, PC
If your DUI was when you were 16, it would be part of your juvenile record which is a public record. Because it was a moving offense, it would also be on your driving record if a complete driving record was obtained. As for employment, since it was 7 years ago and you have no other offenses, you may be able to make disclosure and explain that it was a dumb mistake made in your youth. Most insurance companies should not have a problem with an offense that old.

Can I obtain an attorney even if the DA is in charge of my case?

default-avatar
Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
Sounds like this is a criminal case, and you may be the "victim/witness". If that is the case, the answer is "No". In a criminal case, the DA actually represents the State. He does not technically represent you. While you may be the "victim", you are a witness to the crime that was committed. If you want to see something more than criminal prosecution, ,then you may want to hire an attorney to sue the defendant civilly. That is an entirely different type of case.

What are the statute of limitations of a DUI to get my driver's license back?

Criminal Law lawyer at Klisz Law Office, PLLC
Not everything you said sounds correct. If your license was revoked, you must have at least 2 or more DUIS.
